Official Contest Rules - Syndicate Sweepstakes

1. (a) To enter visit www.hrtv.com and click on Contests. Complete the entry form and press submit. Contest opens at 12:01 am on Friday, February 29, 2008. All entries must be received by 11:59 pm on Sunday March 30, 2008 (the “Contest Closing Date”) in order to be entered into the draw for a chance to win the Grand Prize. Entries can also be submitted by writing your full name, address, date of birth, email address, telephone number and a statement that you are submitting your personal information in order to be entered into this Contest on a card and sending it to HRTV Syndicate Sweepstakes, 285 West Huntington Drive, Arcadia, CA 91007 by the Contest Closing Date.
    (b) Contest is open to residents of the 50 United States and District of Columbia only, aged 21 years or older, excluding officers, directors or employees of HRTV LLC, West Point Thoroughbreds, Inc., their respective parent and affiliate companies, representatives, agents, the contest prize sponsors and suppliers and those with whom they are domiciled. VOID WHERE PROHIBITED.
    (c) The winner will be determined by a random draw, conducted by HRTV, LLC from all completed entry forms received as of the Contest Closing Date. The random draw will take place on Sunday, April 6, 2008 between 1:00 pm and 2:00 pm PT at Santa Anita Park and may take place live on-air on the HRTV television network. Selected entrant will be contacted by e-mail and/or telephone.
    (d) If a selected entrant cannot be reached by April 13, 2008, declines the prize, or is determined to be otherwise ineligible to receive the Grand Prize, another entrant will be selected by a random draw of the remaining eligible entries on or before April 14, 2008.
    (e) Only one (1) entry per person. If the identity of an online entrant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry. All online entries must be submitted from a valid email account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s). Multiple entries from the same person using different email addresses will be disregarded and use of any scripts or other automated means to enter online is strictly prohibited.
    (f) This contest is being run by HRTV, LLC (the “Contest Sponsor”) and the prize is sponsored by West Point Thoroughbreds, Inc. (the “Prize Sponsor”) (and collectively the “Sponsors”).
2. No purchase or expenditure or investment is necessary to enter this contest. Making a purchase will not increase your chances of winning the Grand Prize.
3. One (1) GRAND PRIZE: The Grand Prize Winner will receive a prize consisting of cash equal to 5% of the disbursements received by the owners of the thoroughbred race horse Jeanine’s Vow (or another thoroughbred race horse as determined at Prize Sponsor’s sole discretion) (the “Grand Prize”) arising out of said horse’s participation in races and other competitions during the 2-year period beginning April 7, 2008 and ending April 7, 2010 (the “Prize Period”). The approximate retail value of this prize is unknown at this time as the amount, if any, of the disbursements is subject to and contingent on the future performance of the horse during the Prize Period. Each entrant agrees and acknowledges that Sponsors do not guarantee or warrant any amount of disbursements during the Prize Period. This prize is subject to Prize Sponsor’s terms and conditions, which the winner will be required to accept as a condition to receiving this prize. Grand Prize Winner will not take possession of the horse, and will have no ownership interest or rights in the horse or in any legal entity that owns the horse. Grand Prize Winner is solely responsible for any and all taxes and other legal disclosures associated with the Grand Prize including, but not limited to, any associated future disbursements, and for determining whether Grand Prize Winner is legally permitted to receive the cash disbursements in the state in which he/she resides.
4. The Grand Prize must be accepted as awarded and cannot be redeemed for cash or substituted for any other item. In its sole discretion, Prize Sponsor reserves the right to substitute the Grand Prize, or any element thereof, with a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised Grand Prize.
5. Contest Sponsor’s rulings are final and without appeal in all matters relating to the promotion and awarding of the Grand Prize.
6. Selected entrant will be required to return a signed affidavit of eligibility, release and acknowledgement form to Contest Sponsor and return a signed contract to Prize Sponsor before being declared the Grand Prize Winner and awarded the Grand Prize.
7. By entering this Contest, each participant agrees that (i) if the participant is a winner of the Grand Prize, Sponsors may contact that participant by e-mail, phone or postal mail; (ii) if the participant is the winner of the Grand Prize, to the use of his/her entry, name, address and/or photograph in any publicity carried out by Sponsors and/or their advertising agencies, without further compensation, and to his/her photograph being taken by Sponsors for such use, without further compensation, except where prohibited by law; and (iii) participant releases Sponsors, and their parents, affiliates, and subsidiaries, the service agencies, and independent contractors of any of the above organizations, and their respective directors, officers, employees, and agents, including advertising and promotion agencies, from any and all liability, loss or damage arising out of their participation in the contest and with respect to the awarding, receipt, possession, use and/or misuse of any prize. All entries become the property of the Sponsors.
8. This contest is subject to all applicable U.S. local, state and federal laws and regulations and is void where prohibited. The sole and exclusive venue for any legal action relating to or arising out of this contest shall be a court of competent jurisdiction located in California.
9. No correspondence will be entered into with any participant except with the selected entrants. 10. Chances of winning depend on the number of entries. Sponsors are unaware of how many entrants there may be.
11. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Official Contest Rules may be disqualified by Contest Sponsor. Sponsors take no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.
12. Sponsors assume no responsibility for failure of the Contest website during the Contest period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including injury or damage to a participant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Contest Sponsor reserves the right to suspend the email or online portion of this Contest should a virus, bug or other cause beyond the reasonable control of Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent of the law, including criminal prosecution. Contest Sponsor reserve the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process or the award mechanism, whether on-line or by any other means, to have engaged in any fraud, or to be acting in violation of these rules.
13. The Sponsors are collecting personal data about participants for the sole purpose of administering this contest. No further informational or marketing communications will be received by the participant unless permission to do so is granted by the participant at the time of entry. 14. This Contest is being run in accordance with these rules, subject to amendment by Contest Sponsor as allowed by law. Participants must comply with these Official Contest Rules and will be deemed to have received and understood these rules if they participate in this Contest.
